Summary: I placed two antique items on consignment with this company, and after eight months, a refused letter, and many unanswered phone messages, I have been unable to get the company to pay me or return my items according to our contract.
Details:
On September 4, 2009 I placed two rare Bauer pots on consignment with Nancy’s Estate Sales. According to my written receipt, these pots were valued by Ben Gilmore at $175. Mr. Gilmore told me at that time that upon sale of the items, their value would be paid to me less a 35% commission.
On December 11, 2009 I left a voicemail message for Nancy’s Estate sales asking them to return my call to update me on the status of my items. I received no response. On December 18, 2009 I visited Nancy’s Estate Sales consignment store and spoke with salesclerk Virginia Rogers about my items. At my request, Ms. Rogers contacted Nancy Gilmore by phone. After the call, Ms. Roger’s informed me that Nancy Gilmore had stated that both pots had been sold and that she would contact me on December 20, 2009.
I did not receive a return call, so I again called Nancy’s Estate Sales on December 21, 2009 and December 29, 2009, leaving voicemail messages both times. Again, I received no response.
On January 4, 2010 I mailed a certified letter to Nancy Gilmore at Nancy’s Estate Sales, requesting the return of my two items or payment as stipulated in our contract. According to the U.S. Post Office, Nancy’s Estate Sales refused my letter on January 7, 2010 and refused it again on January 9, 2010.
On May 1, 2010 I called and left a message with Sean, a sales clerk. Again the message was not returned.
